1. Acceptance of the Terms

By accessing or using the website https://neps.academy ("Platform"), you agree to these Terms of Use and to the Privacy Policy. If you do not agree, do not use the Platform.

2. Definitions

"User": a person who accesses or uses the Platform. "User Content": any content created or submitted by the User (for example, solutions, posts, comments, original exercises). "Neps Academy" or "Neps": the entity that controls the Platform.

3. Registration and Account

You must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activities carried out under your account. We may suspend or terminate accounts for violation of these Terms, fraud, or security risk.

4. Licence to Use the Platform

We grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to access and use the Platform for educational and non-commercial purposes. You may not: (a) reproduce, distribute, modify, or create derivative works of the Platform; (b) reverse engineer any part of it; (c) circumvent security measures; (d) mirror or frame the service without authorisation.

5. User Content and Intellectual Property

The User is solely responsible for User Content and declares that they hold the necessary rights to publish it. The User retains ownership and moral rights over their creations.

By submitting User Content, the User grants Neps a non-exclusive, worldwide, royalty-free, indefinite, and revocable licence (by removal of the content by the User), sublicensable to the extent necessary for providing and improving the service (for example, cloud and processing providers), to host, store, reproduce, adapt, translate, distribute, display, and communicate such content to the public in connection with the operation of the Platform, while preserving the author's moral rights (credit and integrity of the work).

We may remove or disable content that violates the law, third-party rights, or these Terms. Neps owns all rights to the Platform and its elements (code, design, trademarks, proprietary and licensed content).

6. Image Rights (disclosure of results)

Upon specific, free, informed, and prominent consent, the User authorises the use of their name, image, and voice for the disclosure of their academic or professional results (for example, medals, admissions, hires) on Neps' institutional channels (website, social media, promotional materials), free of charge and for an indefinite period. Consent may be revoked at any time through the channels indicated in "Contact". Revocation does not affect uses made while consent was valid, and Neps will make reasonable efforts to cease future uses and, when technically possible, remove publications under its control.

7. Privacy and Data Protection (LGPD)

Controller: Neps Academy [full corporate name, company registration number, and address]. Data processed: registration data, Platform usage, results, communications, technical data (for example, logs and cookies). Purposes and legal bases: performance of the contract (service provision, support, billing); legitimate interest (security, fraud prevention, service improvement, statistics); compliance with legal or regulatory obligations; consent (marketing and image clause, when applicable).

Sharing: with operators and partners necessary for operation (hosting, payment methods, analytics, communication), under compatible contracts and security safeguards. Data subject rights: confirmation, access, correction, anonymisation, portability, deletion, information about sharing, and review of automated decisions, as provided by law. 8. Plans, Payments, and Cancellations

Plans, prices, and features are informed on the Platform and may change with prior notice. Subscriptions renew recurrently until cancelled by the User in the account settings. Cancellation prevents future renewals; unless otherwise required by law, amounts already paid are non-refundable, except for the 7 (seven) day right of withdrawal for contracts entered into outside commercial premises, as provided by the Brazilian Consumer Protection Code.

9. Conduct and Acceptable Use

It is forbidden to: violate the law or third-party rights; commit fraud, plagiarism, cheating, or bypass evaluation systems; introduce malware; collect data from other users without legal basis; interfere with the operation of the Platform. Neps may employ automated mechanisms to detect abuse, protect academic integrity, and maintain security.

10. Third-Party Services and Links

The Platform may contain integrations and links to third-party services, governed by their own terms and policies. Neps is not responsible for such services.

11. Disclaimers and Limitation of Liability

The Platform is provided "as is" and "as available". To the fullest extent permitted by applicable law (especially the Brazilian Consumer Protection Code), Neps does not provide guarantees of availability, absence of errors, or fitness for a particular purpose. Neps is not liable for loss of profits, indirect damages, or data loss arising from the use of or inability to use the Platform, except where required by law.

We may contact you by email, in-app notifications, or other informed means. For support, use the official channels indicated on the Platform.

13. Changes to These Terms

We may change these Terms at any time by publishing the new version with its effective date. When there are material changes, we will provide reasonable prior notice (for example, by email or notice on the Platform). Use after the effective date constitutes acceptance of the new terms.

14. Governing Law and Venue

These Terms are governed by the laws of Brazil. For consumers, the venue of their domicile is preserved; for all other cases, the venue of Fortaleza, Ceará, applies.

15. General Provisions

If any clause is deemed invalid, the remaining clauses remain valid. Tolerance of any breach does not imply waiver. These Terms constitute the entire agreement between you and Neps regarding the Platform.
